Developments under the Strata Property Act
If the phases under Part 13 of Strata Property Act and phases for marketing purposes are different, please specify the Part 13 phases only.
For example: several 4-plex townhomes may be grouped together and marketed as "Phase 1" of of a development. But, the developer may plan for each of those 4-plexes to be a separate phase under Part 13 of the Strata Property Act- usually for financial, risk abatement or other business reasons.
Because each phase requires a separate interim budget, the number of phases will affect the cost of our service.
Development under Societies Act, or other
If the development will be a society or other type of association under the Societies Act, Business Corporations Act, or other legislation, please indicate the phases for which a separate budget is required. For example, a developer for a society will typically consider each building a separate phase to avoid paying strata fees on unfinished buildings. However, the constitution and bylaws in such developments will be the guiding documents to determine when fees are payable, regardless of phasing.
Please describe any amenities for the proposed development. Some amenities like meeting rooms may have marginal effect on the interim budget and no effect on the cost of our service. Other amenities, such as pools, saunas, hot tubs, and gyms, may require additional research to estimate operating costs for the interim budget, and therefore may affect the cost of our service.
Please provide any other information that you believe may be relevent to the interim budget for this project. For example, is there an Electric Vehicle charging plan, will the garbage bins be roll-up or partially underground bins (i.e. Molok), etc.
We will correspond with you about the project to get more details. So, do not feel like you must fully describe the project. But, whatever information you can share up front will assist us in planning for this budget.
Proposal
Inspire Property Management Ltd. ("Inspire") proposes to provide limited consultation services for and to the benefit of the proposed strata corporation or society, including assistance on the following matters:
- preparation of an interim budget based on the developer's input and projected costs for maintenance of the common property;
- consult with the developer about building elements that will be used exclusively by the owners of a strata lot or unit, such as balconies, patios, driveways, in-suite elevators, etc., and provide feedback about whether these components should be labelled part of strata a lot or unit, or as limited common or common property to meet the developer's goals for the use and maintenance of these components;
- review and suggest improvements to the draft Owner Developer's Notice of Different Bylaws or constitution and bylaws, taking into consideration the developer's goals for use and maintenance of exclusive use building elements, administration of the strata corporation or society, and marketing of the development;
- consult with the developer about the Rental Disclosure statement and the impact that the rental expiry may have on future owners;
- advise the owner developer about their requirements to hold the first annual general meeting within the prescribed period and assist in calling such meeting to avoid penalties that may apply if the meeting is not held on time.
The Owner Developer understands and agrees that the discount offered herein is conditional, and the Owner Developer must enter into a written agreement with Inspire on behalf of the strata corporation on or by the first conveyance of a strata lot to a purchaser. If a written agreement is not entered into as described above, the Owner Developer agrees to pay to Inspire a fee in the amount described above, plus tax, for services rendered as described herein. This expense, if applicable, will be considered an expense of the now proposed strata corporation. But the expense, if applicable, will accrue in the period prior to the 1st day of the month following the first conveyance of a strata lot to a purchaser occurs, and must therefore be paid by the Owner Developer in accordance with Section 7 of the Strata Property Act.
